Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and QuickFire LLC ("QuickFire," "we," "us," or "our") governing your access to and use of the QuickFire Trivia mobile application and website (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Entertainment Purpose Only
QuickFire Trivia is a skill-based entertainment platform. The Service is provided for entertainment purposes only. QuickFire does not guarantee that any user will earn any particular amount of virtual rewards or gift cards. Past performance in matches does not guarantee future results. The availability, value, and redemption rates of virtual rewards may change at any time at our sole discretion.
2. Not Gambling
QuickFire Trivia is not a gambling platform. All match outcomes are determined entirely by player knowledge and speed of response. There is no element of chance, no random number generation affecting outcomes, and no wagering of money against other players. Tokens used to enter matches are virtual play credits with no monetary value, functionally equivalent to arcade tokens. The gift card reward system is a merit-based incentive program, not a gambling prize system.
3. Eligibility
- You must be at least 13 years old to use the Service.
- Users between 13 and 17 may be subject to additional restrictions depending on their jurisdiction.
- You must provide accurate information including your real date of birth during registration.
- You must have the legal capacity to enter into a binding agreement.
- The Service may not be available in all jurisdictions. It is your responsibility to ensure use of the Service is legal in your location.
- QuickFire reserves the right to restrict or prohibit access to the Service in certain states, territories, or countries at any time. Users located in restricted jurisdictions are prohibited from creating accounts or participating in matches involving rewards. A current list of any restricted jurisdictions will be maintained at quickfiretrivia.com/restricted-jurisdictions.
4. Virtual Currency — Tokens and Tickets
Tokens and Tickets are virtual in-game items only. They have no monetary value, no cash equivalent, and cannot be redeemed for cash under any circumstances. They are not your property — they are a limited license granted by QuickFire to use certain in-game features.
- Tokens are used to enter matches. They can be earned through gameplay or purchased via in-app purchase.
- Tickets are earned exclusively through skillful performance in matches. They cannot be purchased under any circumstances.
- Neither Tokens nor Tickets are transferable between accounts.
- Neither Tokens nor Tickets can be sold, bartered, or exchanged outside of the Service.
- QuickFire reserves the right to modify, adjust, or revoke virtual currency balances at any time, including in cases of suspected fraud, abuse, or violation of these Terms.
- QuickFire reserves the right to modify ticket redemption rates, reward costs, and available reward tiers at any time without prior notice.
- Upon account termination for any reason, all virtual currency is permanently forfeited with no compensation.
- Virtual currency balances do not constitute stored value accounts, prepaid accounts, or any form of financial instrument regulated under applicable banking or money transmission laws.
5. In-App Purchases
- Token purchases are processed by Apple (iOS) or Google (Android) and are subject to their respective terms and refund policies.
- All purchases are final and non-refundable, except as required by applicable law or as determined solely by the platform provider.
- QuickFire is not responsible for purchase errors or unauthorized purchases made through your device.
- Purchasing Tokens does not guarantee winning matches or earning gift card rewards.
6. Gift Card Rewards
- Gift cards are fulfilled by Tremendous, a third-party rewards processor, and are subject to their terms.
- Gift cards are delivered to your registered email address. QuickFire is not responsible for delivery failures caused by incorrect email addresses or email provider issues.
- QuickFire is not responsible for gift cards that are lost, stolen, expired, or unused after delivery.
- Redemptions cannot be reversed once processed.
- QuickFire reserves the right to deny, delay, or revoke any redemption request suspected of being obtained through fraud, cheating, automation, or abuse.
- Gift card availability and brand selection may change at any time.
- QuickFire reserves the right to modify reward redemption thresholds and ticket values at any time.
- There is no guarantee of app availability or continued operation of the reward program.
- Void where prohibited by law.
7. Prohibited Conduct
The following conduct is strictly prohibited and will result in immediate account suspension or permanent ban:
- Bots and automation: Using scripts, bots, macros, or any automated tools to play matches, earn currency, or interact with the Service.
- Multiple accounts: Creating multiple accounts to circumvent bans, gain unfair advantages, or manipulate leaderboards or rewards.
- Exploiting bugs: Using any glitch, exploit, or unintended feature to gain in-game advantages.
- Reward manipulation: Any attempt to manipulate the ticket or redemption system to obtain rewards not legitimately earned.
- Account sharing: Sharing account credentials or allowing others to play on your account.
- VPN and location spoofing: Using VPNs, proxies, or other tools to misrepresent your location or circumvent geographic restrictions.
- Cheating tools: Using any third-party software, hardware, or method to gain an unfair advantage in matches.
- Identity misrepresentation: Providing false information including age, name, or email address.
- Harassment: Harassing, threatening, or abusing other users through any feature of the Service.
- Unauthorized access: Attempting to access accounts, systems, or data not belonging to you.
- Reverse engineering: Decompiling, disassembling, or otherwise attempting to extract source code from the app.
- Emulator use: Use of emulator environments or virtual devices where prohibited by QuickFire, or using emulators to circumvent device-based restrictions.
8. Anti-Cheat and Fraud Detection
QuickFire employs automated systems and behavioral analysis tools to detect prohibited conduct. These systems monitor gameplay timing, answer patterns, account activity, device fingerprints, and network information. Accounts flagged by our systems may be suspended pending review. QuickFire reserves the right to make final determinations regarding violations of these Terms after reviewing available information and internal fraud-prevention systems. Users who believe their account was incorrectly flagged may appeal by contacting support@quickfiretrivia.com.
9. Account Suspension and Termination
- QuickFire reserves the right to suspend or permanently terminate any account at any time, with or without notice, for violation of these Terms, suspected fraud or cheating, extended inactivity, or at our sole discretion.
- Upon termination, all virtual currency, tickets, and unredeemed rewards are permanently forfeited.
- QuickFire is not obligated to provide a reason for termination.
- Users who are permanently banned may not create new accounts. Circumventing a ban by creating a new account is a violation of these Terms and may result in legal action.
10. Intellectual Property
All content in QuickFire Trivia — including game modes, questions, graphics, audio, branding, code, and design — is owned by or licensed to QuickFire LLC and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal entertainment purposes only. You may not copy, reproduce, modify, distribute, or create derivative works from any content without our prior written permission.
11. App Availability
QuickFire does not guarantee that the Service will be available at all times. We may modify, suspend, or discontinue the Service or any feature at any time without notice or liability. We are not responsible for any loss of virtual currency, tickets, or rewards resulting from downtime, technical failures, or discontinuation of the Service.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. QUICKFIRE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUICKFIRE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF VIRTUAL CURRENCY, TICKETS, REWARDS, DATA, OR PROFITS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE 90 DAYS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify, defend, and hold harmless QuickFire LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another party.
15. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Los Angeles County, California, unless the parties agree otherwise. The arbitrator's decision shall be final and binding.
Class Action Waiver: YOU AND QUICKFIRE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. If this waiver is found unenforceable, the entire arbitration section shall be void.
JURY TRIAL WAIVER: YOU AND QUICKFIRE EACH WAIVE ANY RIGHT TO A JURY TRIAL WITH RESPECT TO ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE.
Notwithstanding the above, either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm.
16. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. To the extent arbitration does not apply, you consent to the exclusive jurisdiction of courts located in Los Angeles County, California for resolution of any disputes.
17. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes through the app or by email at least 14 days before the changes take effect. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and QuickFire LLC regarding the Service and supersede all prior agreements and understandings.
